When you make it clear you value someones opinion (by something as easy as asking for it), you demonstrate that youd like to hear from that person (and everyone wants to think their colleagues hold a high opinion of them). So, share something youve been considering, and follow up with any variation of Do you have any suggestions? or Id love to hear what you think 4. Would You Like to Grab a Cup of Coffee?Yes, spending a littl e time together outside the office to build your bond is a pretty obvious tactic. However, all too often, people only grab coffee with the colleagues they already have a killer working relationship with. And, by continually excluding the person you dont know very well, youre bedrngnis doing that relationship- or your general likability rating- any favors.So, next time youre headed out to grab something to drink, invite the office newbie on the team or the person who you dont know very well. One of the most common assumptions that people make â€" and that we find ourselves refuting day in and day out as recruiters â€" is the assumption that personal branding and networking are tasks  you  only need to focus on when youre  looking for a job. Our lives are busy and only getting busier between work, family, and all the myriad forms of entertainment competing for our attention. Its no surprise, then, that people treat personal branding and networking as in-between-jobs activities. With so little time on our hands, of course we only think about gussying up our resumes and LinkedIn profiles when were looking to make career moves or changing circumstances launch us on the job hunt again. The fact is, its harder to accomplish solid personal branding when youre in between jobs. While we wouldnt suggest that personal branding or networking were  more important than work or family, we do think its easy to make continuously building your professional online presence a small part of your social media ritual. (Plus, its more  productive than checking Facebook yet again today.) Its easier to find a job when youve put in the legwork and built your brand beforehand. Furthermore, having a solid personal brand on LinkedIn and other professional networks pays dividends even if youre the furthest thing from an active candidate! A  solid personal brand will help your career in a number of ways that have nothing to do with looking for a job. LinkedIn Profiles Are Still the Most Valuable Personal Branding Tools for Most Professionals LinkedIn faces some declining user engagement numbers, which is part of why many are hoping Microsoft will help right the ship following its relatively recent acquisition of the company. However, the network is still incredibly valuable, regardless of the challenges it faces Many people recognize that they should have a LinkedIn profile. Unfortunately, most of them make a bare-bones attempt and leave their profile almost empty for months, thinking that theyve checked off that box.  But as weve written about quite a bit, those skeletal profiles can actually hurt your personal brand far more than they can help it. How Does a Record Label Decide What Advance to Pay Me How Does a Record Label Decide What Advance to Pay Me One thing that often tempts musicians into signing a record deal is the promise of an advance. This is especially true for up-and-coming acts who have been slogging through on their own dime and making many financial sacrifices in the process. An advance! they say. Were going to be rich! Well, not so fast. The most important thing to remember is that an advance is just that: an advance. Its an advance against royalties you expect (hope) to earn on future record sales, and the label requires a return of the advance. In fact, they will keep revenues until they recoup the full amount of the advance, and that holds true across multiple albums and advances. Thats because record label advances are cross-collateralized - a very important concept to master; so learn more about that here. Theres your warning about getting too excited about advanced cash. But now for what you really want to know - how do record labels decide how much of an advance to pay? How Do They Decide? The answer is that it is part art and part science. For your first advance - the advance for the first album you record with a label as part of a multi-album deal or for the only album in a single album deal - the label will consider a lot of different factors. Indie labels, in particular, will consider how much they can afford to pay and still have enough cash left to promote the album release. If working with an indie, opting for a small advance in exchange for a bigger promo spend is the right choice in the long run. Considerations Major labels will consider things like how much they plan to spend on promotion in addition to how many copies they think they can sell off your release in order to recoup your advance and make extra money. Of course, indie also considers sales potential, but for many indies, its a pure cash flow issue. Even if they think you can sell millions, they cant pay you an advance to cover that. Thats the art part. Labels consider your sales potential, often based on what youve accomplished before, as well as plans for touring, feedback received on your music, and more. However, its still a gamble for they dont know if the advance is going to be too small, too big, or just right (though you can count on them trying to err on the side of caution unless you are the subject of an intense bidding war). The science part comes in with the advance formula associated with multi-album record deals. These formulas arent included in all record deals, but if youre signing with a major label, a good lawyer can insist that your contract includes a formula. How this works is by setting out a  mathematical equation for determining the advance for each album in a multi-album deal. This equation usually sets the advance as a percentage of royalties earned on the previous album. There is also usually a minimum and maximum payout amount stipulated in the formula. The percentage is computed using sales from within a specified territory during a specified period (e.g., sales in the US for nine months after the album release). The formula is applied to each release; so, album two sales will determine album threes advance, album threes royalties will determine album fours advance, and so on. The beauty of the formula is that it rewards good sales and conserves when sales have dropped. Conclusion The best thing to understand about advances, however, goes back to the beginning: this isnt free money. Its more like credit. Take what you need and wait for your sales to come in; it will put you in better control of your career.

Using Decision Theory to Make Your Workplace Efficient Using Decision Theory to Make Your Workplace Efficient You’re familiar with Decision Theory (or Game Theory) whether you know it or not. You may have seen the movie A Beautiful Mind, about John Nash, who was a pioneer in this field. Or, you’ve probably discussed in a class or retreat the most famous decision theory case: The Prisoner’s Dilemma. In the Prisoner’s Dilemma, you have two prisoners who have committed a crime together, but you dont have enough evidence to send them to jail for the term they deserve. The detective separates the prisoners and gives them options. If neither prisoner confesses, both will go to jail for one year.If you confess and your partner does not, you go free, and your partner goes to jail for ten years.If you do not confess and your partner does, your partner goes free, and you go to jail for ten years.If both of you confess, you both go to jail for five years. So, what does the prisoner do? It depends on how much you trust your accomplice. How Does Decision Theory Relate to Human Resources and Management? If this doesnt seem to relate to management or Human Resources (at least most of the time you’re not dealing with police investigations), in reality, these are the types of decisions you make every day. Think about year-end raises. You have a total of $3,000 to divide between two employees. Here are some of your options. Give the total amount to the star performer.Divide the money evenly.Give 75 percent to the star, 25 percent to the other person. You can consider many ways to divide the money, but just like in the prisoner’s dilemma, you’ll experience the consequences of your decision. If you give all of the money to the better performing employee, you’ll probably keep that person happy, but you’ll damage the morale of the other employee. If you split the money, 50/50, the star will feel like she’s worked super hard for no reason, while the less productive employee will see no reason to improve. You have to strike a balance, and that’s where decision theory comes into play. Decision Theory Requires You to Thoroughly Consider Your Options The decisions you make should be logical- you should think through your options when you make choices. Sometimes you can use a decision tree to consider all of your options. Usually, these are yes/no options. You’ve probably seen funny decision making trees on the internet, but you can use them for a variety of practical decisions. They can help you sort through the what-ifs of any situation or decision. For instance, if you are considering implementing a dress code, you can use a decision tree to help you determine what type of dress code will work for your business. Your decision tree would start like this: Are your employees customer-facing in their jobs? If yes, do the customers expect business dress? If no, do you have safety issues? You can work through the yesses, and nos to figure out what will work the best in your organization. If you determine that the employees are not customer facing and they have no safety issues, then open-toed shoes are appropriate for your dress code. If the employees are customer facing, but the customers don’t expect business dress, then you can go for a business casual dress code. You may say that you can make these decisions without a decision tree, and it’s highly likely that you can. But, youll be surprised how often companies don’t think through the yesses, and nos of a decision tree. It is how you end up with crazy policies that require IT people, who crawl on the floor to connect wires under desks, to wear suits.   Or, you enable employees to wear open-toed shoes company-wide, rather than just in the office, when factory employees who work with products could easily break their toes. Apply Decision Theory to Potential Personal Conflicts Figuring out the consequences of each decision an employee makes is often tricky, but in this example from the news, going through the decision tree would have helped. A Starbucks in Philadelphia made the news when the manager called police on two black men who were sitting in the cafe and had not ordered anything. Her decision tree should have looked like this. Have they ordered anything?If yes, leave them alone.If no, have you spoken to them?If no, speak to them.If yes, what did they say?If “we are meeting someone here,” then check back in 15 minutes.If “we are just hanging out,” remind them that they need to place an order. If the manager followed this same decision tree with every person who sat at a table- regardless of their race, you would have seen a different outcome. Going through these thought exercises can help remove any biases that you may have- conscious or unconscious, from the decision making. Decision theory has plenty of practical applications, and you can use it within HR and management to discover clear answers about what you should do in any given situation. Decision theory can help you explore the likely consequences of each action you take or decision you make. It is helpful for everyone- your employees, customers, managers, and other stakeholders.

Power of Attorney FAQ - Australia-VIC Power of Attorney FAQ - Australia-VIC General InformationWhat is a Power of Attorney?A Power of Attorney is a document in which one person (the Donor) appoints another person (the Attorney) to act for him or her. There are many reasons why you might want to appoint someone else to look after your financial affairs. For example, if you are going to be out of the country for a lengthy period of time, you might want someone to do your banking while you are gone. If you are approaching old age, you may want to give a Power of Attorney to a person you trust so that he or she can manage your property for you. What are the differences between enduring and ordinary Powers of Attorney?There are two major types of Powers of Attorney: ordinary and enduring. An ordinary Power of Attorney is only valid as long as the Donor is capable of acting for him or herself. If the Donor dies or becomes mentally incompetent, the Power of Attorney is invalidated. An Enduring Power of Attorney remains valid even if the Donor later becomes mentally incompetent. (Note: the Donor must be competent at the time the Power of Attorney is made.) In either case, the Power of Attorney becomes invalid when the Donor dies. A Power of Attorney cannot be used to bequeath property upon the death of the Donor. What are the differences between general and specific Powers of Attorney?A general Power of Attorney is one that gives the Attorney the authority to do anything the Donor could do him or herself. A specific Power of Attorney is one that gives the Attorney authority to act for a particular purpose. (For example: to buy or sell a particular piece of property.) Will a Power of Attorney still be valid after the Donor dies?NO. Generally Speaking, when a person dies, the Executor (also called a Personal Representative) appointed in the person's Last Will and Testament takes control of the deceased person's property and distributes it according to the instructions in the Will. If there is no Will (or if the Will is invalid), each jurisdiction has intestacy legislation that distributes the deceased person's property to his or her relatives according to a set of rules. A court generally appoints an Administrator to oversee this process. Unfortunately, the deceased person's wishes are not taken into account during the process (which can be very lengthy), since they have not been formally expressed in the proper manner. Will a Power of Attorney allow me to appoint someone to make welfare and medical decisions on my behalf?In most of Australia, powers of attorney do not give someone the right to make decisions about your welfare or medical treatment. Usually, a medical power of attorney or anticipatory directive is required to deal with non-financial matters. The exception to this rule is found in Australian Capital Territory and Queensland. In the Australian Capital Territory you can use your Enduring Power of Attorney to appoint someone to run your everyday affairs (other than property and money) and consent to medical treatment and medical donation while you are incapacitated. In Queensland you can use your Enduring Power of Attorney to appoint someone to make personal and health decisions when your capacity is impaired. The DonorWho is the Donor?The Donor is the person who needs someone else to act for him or her. The Donor must be an adult. The Donor must be capable of making his or her own decisions at the time the Power of Attorney is executed (signed). What is incapacity?A person is incapable of managing property if the person is unable to understand information relevant to making a decision about the management of property, or if the person cannot appreciate the foreseeable consequences of making (or not making) a decision about the management of property. The AttorneyWho is the Attorney?The person appointed by the Donor is called the Attorney. The Attorney is the person who acts for the Donor. Does the Attorney have to be a lawyer?No, there is no need for the Attorney to be a lawyer. (See below for Attorney qualifications.) What qualifications does an Attorney need to have?The Attorney must be a capable adult. The Attorney cannot be an undischarged bankrupt. The Attorney should not be the owner, operator or employee of a nursing home or extended care facility in which the Donor is a resident. What qualities should I look for in an Attorney?Your Attorney must be someone whom you trust completely. In addition, remember that your Attorney will have complete authority to deal with your financial and legal affairs (subject to any limitations or restrictions specified in your Power of Attorney). You should ensure that the person you choose has adequate financial management skills and sufficient time to handle your affairs properly. Your Attorney must be available when required, be able to objectively make decisions and be able to keep accurate financial records. What are the responsibilities of my Attorney?Your Attorney has the following responsibilities: to act in your best interest; to keep accurate records of dealings/transaction undertaken on your behalf; to act for you with the utmost good faith and to avoid situations where there is a conflict of interest; and to keep your property and money separate from their own. Is it okay to appoint a relative as Attorney?Yes, people often appoint relatives as Attorneys. Can my Attorney also be a beneficiary in my will?Yes. What are Joint or Joint Several Attorneys?Sometimes a Donor will want to appoint two Attorneys. In that case the Donor must decide whether the Attorneys will be 'joint' Attorneys or 'joint and several' Attorneys. Joint Attorneys must act together. They must both agree before any action can be taken, and they must both take the same action at the same time. If one is absent, no action can be taken. Joint and several Attorneys can act together or individually. Either one can take an action without consulting the other. If one is absent, the other can still act. In Victoria, what is an Alternate/Substitute Attorney? Do I need one?It is a good idea to appoint an alternate/substitute Attorney but it is not absolutely necessary. An alternate/substitute Attorney can only act when the Attorney is unable or unwilling to continue acting for the Donor. Note: A third party (e.g. the Donors bank) may require proof that the original Attorney is unable to continue as Attorney before accepting instructions from the alternate. Where two Attorneys have been appointed, the document may state that if one dies or is otherwise incapable of acting, the other will continue as sole. Victoria: I am an Attorney. How should I sign documents on the Donor's behalf?There is no one standard way for an Attorney to sign documents. However, when you do sign, it is important that you clearly state who the Donor is and that you are acting as their Attorney. One convention is to write the Donor's name, then sign your name, and then indicate that you are the Attorney. The following is an example: John Johnson, by Jane Smith, Attorney. You should always have a copy of the Power of Attorney with you whenever you are acting as an Attorney. You may be required to sign an affidavit stating that the Power of Attorney is valid, that it hasn't been revoked, and that the Donor is still alive. And remember: failure to comply with directions given by the Donor, without reasonable cause, can leave you subject to civil liability for any damages caused by noncompliance. Place and TimeWhat is Jurisdiction?A jurisdiction is a place that has its own laws. It is a territory with boundaries, such as a state or a province. For example, California is a jurisdiction in the United States, Ontario is a jurisdiction in Canada, Scotland is a jurisdiction in the United Kingdom and Queensland is a jurisdiction in Australia. What is the Governing Law?A Power of Attorney is governed by the law of the jurisdiction where the actions of the Attorney will be performed. Normally, this is the place in which the property of the Donor is located. Therefore, it is not a good idea to appoint an Attorney who resides in a different jurisdiction, unless the property or assets you want the Attorney to deal with are also in the different jurisdiction. If you anticipate that your Attorney will be acting in more than one jurisdiction, you should probably make separate Powers of Attorney for each jurisdiction. Examples: If your bank accounts and other property are located in the jurisdiction where you live, you will want to appoint an Attorney who lives in the same jurisdiction. If you live in one jurisdiction but have a bank account or other property someplace else, and you want an Attorney to deal with that property, you will want to choose the place where the property is located as the governing law, and appoint an Attorney who is located in (or is willing to travel to) the same jurisdiction as the property. When does a Power of Attorney start?A Power of Attorney can start on a date specified in the document, or upon the occurrence of an event (such as disability or incompetence). If there is no specified date or event, a Power of Attorney starts immediately upon execution. NOTE: In Victoria, an Enduring Power of Attorney does not confer authority until the Attorney signs the Statement of Acceptance. How/when does a Power of Attorney end?An ordinary Power of Attorney ends automatically when the Donor becomes mentally incapacitated or dies. An Enduring Power of Attorney ends automatically when the Donor dies. As long as you are mentally capable, you may revoke your Power of Attorney at any time by notifying your Attorney (in writing) that the Power is revoked and destroying the original Power of Attorney. Otherwise, a Power of Attorney continues in effect indefinitely, unless the document specifies an end date. Can I revoke my Power of Attorney after I have become incompetent?A person who is incompetent cannot revoke an Enduring Power of Attorney. However, an ordinary Power of Attorney is automatically revoked when the Donor is found to be incompetent. How do I revoke my Power of Attorney?You can revoke, or cancel, a Power of Attorney by giving your Attorney a written notice saying that his or her power has ended. Also, you may make a new Power of Attorney that states your previous Power of Attorney is now revoked (but you must still notify the previous Attorney of the revocation). Third parties (e.g., people or organisations that have been dealing with the Attorney) must also be notified. Additionally, if your Power of Attorney is registered you must also register the revocation. Please note that if you fail to inform your attorney of the revocation, your Attorney can legally continue to make decisions on your behalf. PowersShould I put restrictions on my Attorney?When you give a general Power of Attorney, you give your Attorney the authority to do anything you could do yourself, with a few exceptions - such as areas where you possess skills that your attorney doesn't (e.g. if you are a dentist, you cannot authorise your Attorney to practice dentistry on your behalf). But there may be some things you would prefer your Attorney did not do. I used to tell my staff that in nearly every case, the way they handled a mistake mattered far more to me than the mistake itself. Downplaying a mistake is one of the worst things you can do on the job. If your boss isn’t confident that you’ll give her bad news directly or be forthright about a problem, you’ll destroy her trust in you. If you don’t proactively own up to and take responsibility for mistakes, you’re signaling that she can’t count on you to keep her informed when it counts. A smart manager will respond to that by giving you less autonomy and high-profile, important work. The best thing you can do when you make a mistake it to come clean. Explain what you did, why you were wrong, and what you propose doing about it now. This also works in retrospect.
