How two restauranteurs prevent friction and frustration
How two restauranteurs prevent friction and frustrationHow two restauranteurs prevent friction and frustrationCraig and Annie Stoll opened Delfina restaurant in San Franciscos Mission District in 1998. The husband and wife team borrowed money and maxed out their credit cards to make it happen. Delfina has been a hit with locals and critics ever since. In 2008, Craig won the James Beard Award Award for the best Chef in the Pacific region (California and Hawaii). Delfina is renowned for its seasonal Italian dishes, rustic pastas and pleasures ranging from roasted whole baby cauliflower, to grilled Monterey Bay Calamari, to a huge steak - a dry-aged bistecca alla fiorentina. Craig and Annie have built a mini-empire, the Delfina Resturant Group, which comprises the original fine-dining Delfina, Laconda (inspired by casual osterias in Rome), and four Pizza Delfina restaurants (with a fifth on the way) that serve wonderful mafiatorte (below is one of my favorites, Salsiccia) along with di verse Cal-Italian dishes ranging from stone fruit salad, to meatballs to mussels.Craig and Annie are the co-stars of the new episode of our FRICTION podcast, Cant stand the heat? Get out rid of the friction. Roughly speaking, Craig focuses on the managing the food and chefs and Annie focuses on servers and other the front of the house issues - and is deep into management details ranging from hiring and firing, to daily crises, to dealing with upset customers. That said, they talk about and work on all things Delfina together - and there is a healthy, and loving, tension between the two, as their styles, focus, and skills are so different and so complimentary. They view their challenge at Delfina, Laconda, and Delfina Pizza as akin to putting on a Broadway play every day. Or more precisely, six (soon seven) different plays each day. I welches taken by how much they rely on rhythms to constrain and coordinate action (much as professor Kathy Eisenhardt suggested in her FRICTION episod e on simple rules). They watch for missed handoffs, delays screw-ups, and other subtle hints that things have gone off the rails, or are about to do so. All of us at Stanford eCorner who work on the FRICTION podcast believe this is among the fruchtwein engaging and instructive episodes in the (now) two-season series. I suggest you listen to it. This written piece (or the transcript) cant replace the grit, good humor, mutual affection conveyed by Craig and Annies voices. To whet your appetite for the podcast, consider a few of my favorite quotes (some lightly edited for clarity and length) and some light analysis. Their focus rhythm and red flags starts bright and early with Annies daily routineAnnie I see the emails that come through from every single restaurant, and I also see everything thats uploaded to Box in our Cloud to keep my finger on the pulse. Also, first thing in the morning, at 600 in the morning, with my coffee, I go through the reservation books, and Ill never stop doi ng that. This habit enables Annie to link the daily rhythm of her actions to the daily rhythm of life in each restaurant. And consistent with what Huggy Rao and I discussed in Bad to Great, this duo is especially focused on averting and repairing problems. As piles of research demonstrate, bad is stronger than good, so eliminating the negative is essential for sustaining and spreading excellence in any organization. Annie and Craig know that things will go wrong, that things can always be a little better, and thus look for red flags at every turn. As they saidAnnie I mean, its off the rails every minute.Craig Every day. Its not will something go wrong today? Its what will go wrong today?I was taken with the ripple effects that Craig described in the quote below - a compelling illustration of why many small problems are essential to nip in the bud - especially those that are linked to other essential and interconnected tasks. He explains how a few missing spoons can trigger systemic friction and frustration for servers and customersCraig Theres just so many moving parts, that if one of them is out of sync, or out of rhythm, it messes everything up. If the dishwasher is not doing their job, and washing things, and then bringing them out to the dining room, putting them where theyre needed, then the servers dont have any spoons to go and set the table with. It slows them down, and theyre not there for the guest who didnt like their soup, so the guest is upset, cause theyre flagging down the waiter, and the waiters off trying to get a spoon. This simple spoon that he needs, because the dishwasher wasnt trained, or is too slow, or didnt show up that night, or whatever, so theres this dominospiel effect.Craig and Annie also use predictable rhythms to help their employees and themselves plan and coordinate predictable and necessary, but less frequent, activitiesCraig We still personally do the new hire orientations. Every six weeks, its the Annie and Craig show.Anni e Its very important that everybody knows and understands our culture and values - that we live by, that everyone needs to live by. So in those orientations, we go through the mission statement and the core values, and how we started and who we are. So that can never change. Finally, returning to the bad to great theme, Craig talks about constantly making small changes that improve the customers experience, save money, and are opportunities to teach his staff skills and accountability.Craig Every restaurant I walk into, I immediately adjust the lights and music. Cleanliness, I mean, I look for smudges in mirrors, I look for recycling, composting, and trash. So one of the first things I do when I walk into one of our kitchens is I go straight to their composting bin, and the trash bins, and the recycling. Ill pick up a can of olive oil, and Ill shake it, and Ill say, Do you know what that sounds like in there? It sounds like money. Thats money, thats olive oil. There is much more in t he podcast. They talk about what they look for when hiring people - the standards are a bit different than in other industries (Annie looks for candidates who are on time and dont smell of alcohol). Craig talks about red flags that indicate people need more training. Annie talks about the importance of starting meetings on time, They both talk about the joys of great regular customers and challenges of dealing with rude, impatient, and overly demanding customers (including the satisfaction that comes with doing it well). I hope you enjoy the conversation.Thisarticlefirst appeared on LinkedIn.

4 Questions Thatll Make You More Likable at Work - The Muse
4 Questions Thatll Make You More Likable at Work - The Muse4 Questions Thatll Make You More Likable at WorkSometimes you inadvertently say things that scare your colleagues into thinking somethings much worse than it is.Its elend intentional Its just that youre busy and you dont always have the time to think through how youre coming off. However, just like there are phrases that cause a visceral negative reaction, there are also some thatll instantly make your co-workers smile- and improve your workplace relationships. Not only that, theyre so common that incorporating them into your communication at work will feel like second nature.Seriously, give one of the below options a test run this week- you just might make someones day.1. How Can I Help? Its natural to get caught up in your own work- after all, thats your job. But if you always look too busy to connect with your co-workers, you might seem a little self-involved. An easy fix is to look up from your desk and simply ask what a c o-workers working on- and if theres any way for you to pitch in and help. This simple two-part question reinforces the idea that youre a team player willing to take time out of your schedule to support someone else. Because youre actively demonstrating that youre bedrngnis too busy to be bothered, youll be seen as more friendly, more approachable, and yes, more likable.2. Could You Tell Me More?Maybe you really are too busy to lend a hand, but I bet you have a couple of minutes to actively listen to your co-worker. And sometimes, thats all it takes to make someones afternoon.Do you ever feel like you need to give a one-line summary of your latest project so you dont overwhelm (or bore) someone? Compare that to how it feels when someone makes it clear he has the time- and interest- to hear the fleshed out version of your idea. You come away from the two interactions with two different sentiments. When someone listens to you, you feel that person is extra considerate, and someone you could reach out to in the future. So, next time someone tells you shes trying to come up with a new protocol, and says, but you probably dont want to hear all about that follow up with, If you have the time, Id love to hear more. 3. What Are Your Thoughts on This?As I was speaking with someone the other day, she tossed out an idea shed been brainstorming and asked if I had any thoughts on the subject. Shes a pretty prestigious person, and the fact that she wanted to hear from me instantly made her feel more approachable. Its intuitive- but its often overlooked. When you make it clear you value someones opinion (by something as easy as asking for it), you demonstrate that youd like to hear from that person (and everyone wants to think their colleagues hold a high opinion of them). So, share something youve been considering, and follow up with any variation of Do you have any suggestions? or Id love to hear what you think 4. Would You Like to Grab a Cup of Coffee?Yes, spending a littl e time together outside the office to build your bond is a pretty obvious tactic. However, all too often, people only grab coffee with the colleagues they already have a killer working relationship with. And, by continually excluding the person you dont know very well, youre bedrngnis doing that relationship- or your general likability rating- any favors. So, next time youre headed out to grab something to drink, invite the office newbie on the team or the person who you dont know very well. Even if you get shot down, youll still make the impression that you tried to get to know him better.Everyone has one (or two, or five) colleagues with whom they wish they had a better rapport. Try one of the above lines tomorrow to make that start happening ASAP. Photo of co-workers courtesy of Shutterstock.

Use this Social Media Strategy to Find a Job
Use this Social Media Strategy to Find a Job Use this Social Media Strategy to Find a Job If a social media strategy isnât at the top of your list when starting your job-searching endeavors, you might find the process slow and tedious. Thatâs because social networks are the way nearly all U.S. companies are finding new employees, according to Jobvite. As you finalize your resume and create drafts for cover letters, be sure to plan your social media strategy as well. Make sure you have a social media strategy to augment traditional methods such as face-to-face networking and informational interviews. Check out the following tips to give yourself an edge in your job search. Brand consistency. Make sure your profile is professional and reflects the job youâre looking for across all social media platforms. Ensure your privacy settings are secure (especially on Facebook). On LinkedIn, make sure your profile is complete with skills and recommendations. On Twitter, link to your website, blog or online resume. And donât forget Pinterest, YouTube, Google+ and Foursquare. Know your audience. Your audience on Facebook is different from your audience on Twitter or LinkedIn, so make sure your updates reflect that. On LinkedIn, share articles and blogs on industry-related topics. On Facebook, post more personal (but not too detailed) updates to remind your friends that youâre in the job market. Be proactive. Use social media to connect with recruiters, employers and employees of companies youâd like to work for. Join â" and participate in â" organizations, groups and blogs in your industry or alumni groups. Become an industry expert or thought leader. Research. Use social media to create your target list of companies, then research those companies and their employees. Use hashtags on Twitter to find jobs. For example, if you are interested in fashion, search #fashionjobs. Sites like Twellow let you search peopleâs bios and the URLs in their bios; you can easily find, follow and engage key employees of those companies so they get to know you before you approach them for a job. Prepare for a job interview by using social media to research the interviewer and find common topics to break the ice. Network online. Expand your network and engage others with similar interests by posting, sharing/forwarding, tweeting and retweeting relevant articles and blogs. This raises your online profile, and encourages others to do the same for you. Twitter works well for this. Know your online profile. Google yourself and make sure what you see is what you want it to be. Go to Klout.com so you can see your âkloutâ score, which reports how influential and engaged you are across platforms. Another great site is wefollow.com, a Twitter directory organized by shared interests or categories. Users can add themselves to the categories that best fit their interests. Today, employers use LinkedIn, Twitter, Facebook and other social media to identify, recruit and check out new employees. The Internet has helped level the job search playing field by offering access to resources that enable you to identify and prepare for career opportunities. But itâs also offered employers access to more talented job candidates. A smart social media strategy can help you stand out and land the job you seek.

Not looking for a Job Right Now You Still Need a Personal Brand!
Not looking for a Job Right Now You Still Need a Personal Brand! Not looking for a Job Right Now You Still Need a Personal Brand! One of the most common assumptions that people make â" and that we find ourselves refuting day in and day out as recruiters â" is the assumption that personal branding and networking are tasks you only need to focus on when youre looking for a job. Our lives are busy and only getting busier between work, family, and all the myriad forms of entertainment competing for our attention. Its no surprise, then, that people treat personal branding and networking as in-between-jobs activities. With so little time on our hands, of course we only think about gussying up our resumes and LinkedIn profiles when were looking to make career moves or changing circumstances launch us on the job hunt again. The fact is, its harder to accomplish solid personal branding when youre in between jobs. While we wouldnt suggest that personal branding or networking were more important than work or family, we do think its easy to make continuously building your professional online presence a small part of your social media ritual. (Plus, its more productive than checking Facebook yet again today.) Its easier to find a job when youve put in the legwork and built your brand beforehand. Furthermore, having a solid personal brand on LinkedIn and other professional networks pays dividends even if youre the furthest thing from an active candidate! A solid personal brand will help your career in a number of ways that have nothing to do with looking for a job. LinkedIn Profiles Are Still the Most Valuable Personal Branding Tools for Most Professionals LinkedIn faces some declining user engagement numbers, which is part of why many are hoping Microsoft will help right the ship following its relatively recent acquisition of the company. However, the network is still incredibly valuable, regardless of the challenges it faces Many people recognize that they should have a LinkedIn profile. Unfortunately, most of them make a bare-bones attempt and leave their profile almost empty for months, thinking that theyve checked off that box. But as weve written about quite a bit, those skeletal profiles can actually hurt your personal brand far more than they can help it. Here are just a few reasons why you should think about building out your LinkedIn profile even if you arent looking for a job just yet: Stakeholders in your current job are checking your profile. Youre visible to vendors, negotiation partners, and coworkers in other departments. A strong personal brand only helps your reputation within your current role. Your supervisors or higher-ups will take a look at your online presence when it comes to promotions. A LinkedIn profile with 15 connections, no picture, and no education or work history might send the message that youre not as committed to advancement in your career as you could be â" especially in customer-facing fields. If you have a great LinkedIn profile, youll show up in searches more often. We always bring this up in the context of hearing from recruiters, but put that aside for a moment. A great LinkedIn profile also means youre also more visible for networking and business development opportunities, possible speaking engagements, and other kinds of activities that will boost your career. A solid LinkedIn profile gives you stronger personal SEO. When someone Googles you, the first thing theyll see is a strong picture of who you are professionally. â" We understand that not everyone knows how to boost their personal brand or build out their LinkedIn profile. If youre finding it particularly difficult, consider reaching out to a consultant or career coach who can help. A version of this article originally appeared on the Argentus blog. Bronwen Hann is a seasoned recruiter with 35 years of experience in the industry. She founded and currently runs Argentus Supply Chain Recruiting.

How Does a Record Label Decide What Advance to Pay Me
How Does a Record Label Decide What Advance to Pay Me How Does a Record Label Decide What Advance to Pay Me One thing that often tempts musicians into signing a record deal is the promise of an advance. This is especially true for up-and-coming acts who have been slogging through on their own dime and making many financial sacrifices in the process. An advance! they say. Were going to be rich! Well, not so fast. The most important thing to remember is that an advance is just that: an advance. Its an advance against royalties you expect (hope) to earn on future record sales, and the label requires a return of the advance. In fact, they will keep revenues until they recoup the full amount of the advance, and that holds true across multiple albums and advances. Thats because record label advances are cross-collateralized - a very important concept to master; so learn more about that here. Theres your warning about getting too excited about advanced cash. But now for what you really want to know - how do record labels decide how much of an advance to pay? How Do They Decide? The answer is that it is part art and part science. For your first advance - the advance for the first album you record with a label as part of a multi-album deal or for the only album in a single album deal - the label will consider a lot of different factors. Indie labels, in particular, will consider how much they can afford to pay and still have enough cash left to promote the album release. If working with an indie, opting for a small advance in exchange for a bigger promo spend is the right choice in the long run. Considerations Major labels will consider things like how much they plan to spend on promotion in addition to how many copies they think they can sell off your release in order to recoup your advance and make extra money. Of course, indie also considers sales potential, but for many indies, its a pure cash flow issue. Even if they think you can sell millions, they cant pay you an advance to cover that. Thats the art part. Labels consider your sales potential, often based on what youve accomplished before, as well as plans for touring, feedback received on your music, and more. However, its still a gamble for they dont know if the advance is going to be too small, too big, or just right (though you can count on them trying to err on the side of caution unless you are the subject of an intense bidding war). The science part comes in with the advance formula associated with multi-album record deals. These formulas arent included in all record deals, but if youre signing with a major label, a good lawyer can insist that your contract includes a formula. How this works is by setting out a mathematical equation for determining the advance for each album in a multi-album deal. This equation usually sets the advance as a percentage of royalties earned on the previous album. There is also usually a minimum and maximum payout amount stipulated in the formula. The percentage is computed using sales from within a specified territory during a specified period (e.g., sales in the US for nine months after the album release). The formula is applied to each release; so, album two sales will determine album threes advance, album threes royalties will determine album fours advance, and so on. The beauty of the formula is that it rewards good sales and conserves when sales have dropped. Conclusion The best thing to understand about advances, however, goes back to the beginning: this isnt free money. Its more like credit. Take what you need and wait for your sales to come in; it will put you in better control of your career.

Using Decision Theory to Make Your Workplace Efficient
Using Decision Theory to Make Your Workplace Efficient Using Decision Theory to Make Your Workplace Efficient Youâre familiar with Decision Theory (or Game Theory) whether you know it or not. You may have seen the movie A Beautiful Mind, about John Nash, who was a pioneer in this field. Or, youâve probably discussed in a class or retreat the most famous decision theory case: The Prisonerâs Dilemma. In the Prisonerâs Dilemma, you have two prisoners who have committed a crime together, but you dont have enough evidence to send them to jail for the term they deserve. The detective separates the prisoners and gives them options. If neither prisoner confesses, both will go to jail for one year.If you confess and your partner does not, you go free, and your partner goes to jail for ten years. If you do not confess and your partner does, your partner goes free, and you go to jail for ten years. If both of you confess, you both go to jail for five years. So, what does the prisoner do? It depends on how much you trust your accomplice. How Does Decision Theory Relate to Human Resources and Management? If this doesnt seem to relate to management or Human Resources (at least most of the time youâre not dealing with police investigations), in reality, these are the types of decisions you make every day. Think about year-end raises. You have a total of $3,000 to divide between two employees. Here are some of your options. Give the total amount to the star performer.Divide the money evenly.Give 75 percent to the star, 25 percent to the other person. You can consider many ways to divide the money, but just like in the prisonerâs dilemma, youâll experience the consequences of your decision. If you give all of the money to the better performing employee, youâll probably keep that person happy, but youâll damage the morale of the other employee. If you split the money, 50/50, the star will feel like sheâs worked super hard for no reason, while the less productive employee will see no reason to improve. You have to strike a balance, and thatâs where decision theory comes into play. Decision Theory Requires You to Thoroughly Consider Your Options The decisions you make should be logical- you should think through your options when you make choices. Sometimes you can use a decision tree to consider all of your options. Usually, these are yes/no options. Youâve probably seen funny decision making trees on the internet, but you can use them for a variety of practical decisions. They can help you sort through the what-ifs of any situation or decision. For instance, if you are considering implementing a dress code, you can use a decision tree to help you determine what type of dress code will work for your business. Your decision tree would start like this: Are your employees customer-facing in their jobs? If yes, do the customers expect business dress? If no, do you have safety issues? You can work through the yesses, and nos to figure out what will work the best in your organization. If you determine that the employees are not customer facing and they have no safety issues, then open-toed shoes are appropriate for your dress code. If the employees are customer facing, but the customers donât expect business dress, then you can go for a business casual dress code. You may say that you can make these decisions without a decision tree, and itâs highly likely that you can. But, youll be surprised how often companies donât think through the yesses, and nos of a decision tree. It is how you end up with crazy policies that require IT people, who crawl on the floor to connect wires under desks, to wear suits. Or, you enable employees to wear open-toed shoes company-wide, rather than just in the office, when factory employees who work with products could easily break their toes. Apply Decision Theory to Potential Personal Conflicts Figuring out the consequences of each decision an employee makes is often tricky, but in this example from the news, going through the decision tree would have helped. A Starbucks in Philadelphia made the news when the manager called police on two black men who were sitting in the cafe and had not ordered anything. Her decision tree should have looked like this. Have they ordered anything? If yes, leave them alone. If no, have you spoken to them?If no, speak to them.If yes, what did they say?If âwe are meeting someone here,â then check back in 15 minutes. If âwe are just hanging out,â remind them that they need to place an order. If the manager followed this same decision tree with every person who sat at a table- regardless of their race, you would have seen a different outcome. Going through these thought exercises can help remove any biases that you may have- conscious or unconscious, from the decision making. Decision theory has plenty of practical applications, and you can use it within HR and management to discover clear answers about what you should do in any given situation. Decision theory can help you explore the likely consequences of each action you take or decision you make. It is helpful for everyone- your employees, customers, managers, and other stakeholders.

Power of Attorney FAQ - Australia-VIC
Power of Attorney FAQ - Australia-VIC Power of Attorney FAQ - Australia-VIC General InformationWhat is a Power of Attorney?A Power of Attorney is a document in which one person (the Donor) appoints another person (the Attorney) to act for him or her. There are many reasons why you might want to appoint someone else to look after your financial affairs. For example, if you are going to be out of the country for a lengthy period of time, you might want someone to do your banking while you are gone. If you are approaching old age, you may want to give a Power of Attorney to a person you trust so that he or she can manage your property for you. What are the differences between enduring and ordinary Powers of Attorney? There are two major types of Powers of Attorney: ordinary and enduring. An ordinary Power of Attorney is only valid as long as the Donor is capable of acting for him or herself. If the Donor dies or becomes mentally incompetent, the Power of Attorney is invalidated. An Enduring Power of Attorney remains valid even if the Donor later becomes mentally incompetent. (Note: the Donor must be competent at the time the Power of Attorney is made.) In either case, the Power of Attorney becomes invalid when the Donor dies. A Power of Attorney cannot be used to bequeath property upon the death of the Donor. What are the differences between general and specific Powers of Attorney?A general Power of Attorney is one that gives the Attorney the authority to do anything the Donor could do him or herself. A specific Power of Attorney is one that gives the Attorney authority to act for a particular purpose. (For example: to buy or sell a particular piece of property.) Will a Power of Attorney still be valid after the Donor dies?NO. Generally Speaking, when a person dies, the Executor (also called a Personal Representative) appointed in the person's Last Will and Testament takes control of the deceased person's property and distributes it according to the instructions in the Will. If there is no Will (or if the Will is invalid), each jurisdiction has intestacy legislation that distributes the deceased person's property to his or her relatives according to a set of rules. A court generally appoints an Administrator to oversee this process. Unfortunately, the deceased person's wishes are not taken into account during the process (which can be very lengthy), since they have not been formally expressed in the proper manner. Will a Power of Attorney allow me to appoint someone to make welfare and medical decisions on my behalf? In most of Australia, powers of attorney do not give someone the right to make decisions about your welfare or medical treatment. Usually, a medical power of attorney or anticipatory directive is required to deal with non-financial matters. The exception to this rule is found in Australian Capital Territory and Queensland. In the Australian Capital Territory you can use your Enduring Power of Attorney to appoint someone to run your everyday affairs (other than property and money) and consent to medical treatment and medical donation while you are incapacitated. In Queensland you can use your Enduring Power of Attorney to appoint someone to make personal and health decisions when your capacity is impaired. The DonorWho is the Donor? The Donor is the person who needs someone else to act for him or her. The Donor must be an adult. The Donor must be capable of making his or her own decisions at the time the Power of Attorney is executed (signed). What is incapacity?A person is incapable of managing property if the person is unable to understand information relevant to making a decision about the management of property, or if the person cannot appreciate the foreseeable consequences of making (or not making) a decision about the management of property. The AttorneyWho is the Attorney? The person appointed by the Donor is called the Attorney. The Attorney is the person who acts for the Donor. Does the Attorney have to be a lawyer? No, there is no need for the Attorney to be a lawyer. (See below for Attorney qualifications.) What qualifications does an Attorney need to have? The Attorney must be a capable adult. The Attorney cannot be an undischarged bankrupt. The Attorney should not be the owner, operator or employee of a nursing home or extended care facility in which the Donor is a resident. What qualities should I look for in an Attorney?Your Attorney must be someone whom you trust completely. In addition, remember that your Attorney will have complete authority to deal with your financial and legal affairs (subject to any limitations or restrictions specified in your Power of Attorney). You should ensure that the person you choose has adequate financial management skills and sufficient time to handle your affairs properly. Your Attorney must be available when required, be able to objectively make decisions and be able to keep accurate financial records. What are the responsibilities of my Attorney?Your Attorney has the following responsibilities: to act in your best interest; to keep accurate records of dealings/transaction undertaken on your behalf; to act for you with the utmost good faith and to avoid situations where there is a conflict of interest; and to keep your property and money separate from their own. Is it okay to appoint a relative as Attorney?Yes, people often appoint relatives as Attorneys. Can my Attorney also be a beneficiary in my will?Yes. What are Joint or Joint Several Attorneys?Sometimes a Donor will want to appoint two Attorneys. In that case the Donor must decide whether the Attorneys will be 'joint' Attorneys or 'joint and several' Attorneys. Joint Attorneys must act together. They must both agree before any action can be taken, and they must both take the same action at the same time. If one is absent, no action can be taken. Joint and several Attorneys can act together or individually. Either one can take an action without consulting the other. If one is absent, the other can still act. In Victoria, what is an Alternate/Substitute Attorney? Do I need one?It is a good idea to appoint an alternate/substitute Attorney but it is not absolutely necessary. An alternate/substitute Attorney can only act when the Attorney is unable or unwilling to continue acting for the Donor. Note: A third party (e.g. the Donors bank) may require proof that the original Attorney is unable to continue as Attorney before accepting instructions from the alternate. Where two Attorneys have been appointed, the document may state that if one dies or is otherwise incapable of acting, the other will continue as sole. Victoria: I am an Attorney. How should I sign documents on the Donor's behalf? There is no one standard way for an Attorney to sign documents. However, when you do sign, it is important that you clearly state who the Donor is and that you are acting as their Attorney. One convention is to write the Donor's name, then sign your name, and then indicate that you are the Attorney. The following is an example: John Johnson, by Jane Smith, Attorney. You should always have a copy of the Power of Attorney with you whenever you are acting as an Attorney. You may be required to sign an affidavit stating that the Power of Attorney is valid, that it hasn't been revoked, and that the Donor is still alive. And remember: failure to comply with directions given by the Donor, without reasonable cause, can leave you subject to civil liability for any damages caused by noncompliance. Place and TimeWhat is Jurisdiction?A jurisdiction is a place that has its own laws. It is a territory with boundaries, such as a state or a province. For example, California is a jurisdiction in the United States, Ontario is a jurisdiction in Canada, Scotland is a jurisdiction in the United Kingdom and Queensland is a jurisdiction in Australia. What is the Governing Law?A Power of Attorney is governed by the law of the jurisdiction where the actions of the Attorney will be performed. Normally, this is the place in which the property of the Donor is located. Therefore, it is not a good idea to appoint an Attorney who resides in a different jurisdiction, unless the property or assets you want the Attorney to deal with are also in the different jurisdiction. If you anticipate that your Attorney will be acting in more than one jurisdiction, you should probably make separate Powers of Attorney for each jurisdiction. Examples: If your bank accounts and other property are located in the jurisdiction where you live, you will want to appoint an Attorney who lives in the same jurisdiction. If you live in one jurisdiction but have a bank account or other property someplace else, and you want an Attorney to deal with that property, you will want to choose the place where the property is located as the governing law, and appoint an Attorney who is located in (or is willing to travel to) the same jurisdiction as the property. When does a Power of Attorney start?A Power of Attorney can start on a date specified in the document, or upon the occurrence of an event (such as disability or incompetence). If there is no specified date or event, a Power of Attorney starts immediately upon execution. NOTE: In Victoria, an Enduring Power of Attorney does not confer authority until the Attorney signs the Statement of Acceptance. How/when does a Power of Attorney end?An ordinary Power of Attorney ends automatically when the Donor becomes mentally incapacitated or dies. An Enduring Power of Attorney ends automatically when the Donor dies. As long as you are mentally capable, you may revoke your Power of Attorney at any time by notifying your Attorney (in writing) that the Power is revoked and destroying the original Power of Attorney. Otherwise, a Power of Attorney continues in effect indefinitely, unless the document specifies an end date. Can I revoke my Power of Attorney after I have become incompetent?A person who is incompetent cannot revoke an Enduring Power of Attorney. However, an ordinary Power of Attorney is automatically revoked when the Donor is found to be incompetent. How do I revoke my Power of Attorney? You can revoke, or cancel, a Power of Attorney by giving your Attorney a written notice saying that his or her power has ended. Also, you may make a new Power of Attorney that states your previous Power of Attorney is now revoked (but you must still notify the previous Attorney of the revocation). Third parties (e.g., people or organisations that have been dealing with the Attorney) must also be notified. Additionally, if your Power of Attorney is registered you must also register the revocation. Please note that if you fail to inform your attorney of the revocation, your Attorney can legally continue to make decisions on your behalf. PowersShould I put restrictions on my Attorney? When you give a general Power of Attorney, you give your Attorney the authority to do anything you could do yourself, with a few exceptions - such as areas where you possess skills that your attorney doesn't (e.g. if you are a dentist, you cannot authorise your Attorney to practice dentistry on your behalf). But there may be some things you would prefer your Attorney did not do. For example, you may want to require that your Attorney get prior approval from you before signing cheques for large amounts on your account. Should my Attorney be allowed to personally benefit from managing my assets? If the person you are appointing as your Attorney is also a member of your family or a beneficiary in your will, you may want that person to be able to personally benefit from managing your assets, since you intend that person to become owner of the assets eventually. Generally, however, it is probably not a good idea to allow your Attorney to personally benefit from managing your assets as this creates a conflict of interest for your Attorney, who is legally obligated to act in your best interest, not his or her own best interest. What can the Attorney do?The Attorney may transact business respecting the Donor's property in all areas specified by the Donor. Is the Attorney obligated to do anything?Generally speaking, the Attorney is not obligated to act for the Donor. However, in some circumstances the Attorney may agree, in writing, to accept an obligation to take action when necessary. When the Attorney acts on behalf of the Donor, the Attorney must act in the best interest of the Donor. Does my Attorney have the authority to act while I am still available and able to take care of my own finances?Generally speaking, a Power of Attorney is effective as soon as it is executed (signed and witnessed, etc.) whether or not the Donor is available or able to handle his or her own affairs. However, the document might specify that it will only be effective under certain conditions. For example, some Powers of Attorney specify that they will not come into effect unless and until the Donor has become mentally incompetent to handle his or her own finances. Note: Some jurisdictions do not allow Powers of Attorney that commence upon the occurrence of a condition or event such as mental incapacity. Signing DetailsWhat does it mean to execute a document? When a person executes a document, he or she signs it with the proper formalities. For example: If there is a legal requirement that the signature on the document be witnessed, the person executes the document by signing it in the presence of the required number of witnesses. How should I sign my Power of Attorney document? To be valid, you must sign the document with your usual cheque signing signature. You should also initial each page of the document. The signing and the initialing of the pages must occur in the presence of your notary or witness(es). After you have signed and initialed your document in front of your notary or witness(es), your notary or witness(es) must sign on the applicable page of the Power of Attorney and should initial each page. This must occur in your presence. Can anybody act as a witness?Your witness(es) cannot be your spouse, partner, child, your Attorney or alternate Attorney, or the spouse of your Attorney or alternate Attorney. Some jurisdictions disallow witnesses that are mentioned in your will, either as beneficiary or executor/executrix. You should generally avoid having witnesses that have any financial relationship with you. The witness(es) must be of legal age in your jurisdiction, they must have capacity and be mentally capable of managing their property and making their own decisions. Who is authorised to witness statutory declarations in Victoria? The following individuals are authorised to witness statutory declarations in Victoria: A justice of the peace or a bail justice A notary public A barrister and solicitor of the Supreme Court A clerk to a barrister and solicitor of the Supreme Court The prothonotary or a deputy prothonotary of the Supreme Court, the registrar or a deputy registrar of the County Court, the Donor registrar of the Magistrates Court or a registrar or deputy registrar of the Magistrates Court The registrar of probates or an assistant registrar of probates The associate to a judge of the Supreme Court or of the County Court The secretary of a master of the Supreme Court or of the County Court A person registered as a patent attorney under Part XV of the Patents Act 1952 of the Commonwealth A member of the police force A sheriff or a deputy sheriff A member or former member of either House of the Parliament of Victoria A member or former member of either House of the Parliament of the Commonwealth A councillor of a municipality A senior officer of a council as defined in the Local Government Act 1989 A registered medical practitioner within the meaning of the Medical Practice Act 1994 A dentist A veterinary practitioner A pharmacist A Donor in the teaching service The manager of a bank A member of the Institute of Chartered Accountants in Australia, the Australian Society of Accountants or the National Institute of Accountants A secretary of a building society A minister of religion authorised to celebrate marriages (not a civil celebrant) A person employed under Part 3 of the Public Sector Management and Employment Act 1998 with a classification that is prescribed as a classification to which this section applies or who holds office in a statutory authority with such a classification. This is a person who holds an office in the Victorian Public Service or a statutory authority that is prescribed as an office to which this section applies A fellow of the Institute of Legal Executives (Victoria). Does it matter where the Power of Attorney document is signed and witnessed? If your document will be used in a different jurisdiction - but not in a foreign nation - there is no problem with having the document signed and witnessed where you live, rather than where the document will be used. The witnessing requirements (number of witnesses required, whether or not notarisation is needed) should still be those of the place where the Power of Attorney will be used, however. Can I use my Power of Attorney in a different state/territory?Some territories and states have mutual recognition provisions in their Power of Attorney legislation which provide portability of powers within Australia. Before trying to use a power of attorney created in a different jurisdiction review the legislation of the jurisdiction where you wish to use the power of attorney to ensure that your Power of Attorney will be accepted. What if my Power of Attorney will be used in a foreign nation? If your document is intended to be used in a foreign nation, you may have to have it authenticated or legalised. This is a process whereby a government official (e.g., the Secretary of State, the Foreign Office, the Office of the Attorney General - depending on where you live) certifies that the signature of the authority (e.g., notary or solicitor) on your document is authentic and should be accepted in the foreign nation. For more information about document authentication and legalisation, contact the local consulate/embassy of the foreign country your document will be going to, or one of the following government web sites: United States: https://travel.state.gov/content/travel/en/legal-considerations/judicial/authentication-of-documents/office-of-authentications.html/ Australia: dfat.gov.au/brisbane/index.html Other Considerations Do I have to pay my Attorney?Depending on the kind of relationship you have with the person who will be acting as your Attorney, you will have to consider whether they should be paid for their services. You can stipulate in your document that your Attorney will not receive any payment except the reimbursement of out-of-pocket expenses, or you can agree to pay your Attorney a specified amount. If you prefer, you can authorise your Attorney to pay him or herself a reasonable amount for acting for you. However, you do not need to pay your Attorney for the power to be effective. Generally, payment is only made when a trust company or other professional person/organisation is acting as your Attorney. Should I have my Attorney prepare financial statements? You can require your Attorney to prepare periodical financial statements and send them to your accountant, lawyer or some other person you choose. This is a good deal of work, however, and most people do not require it of unpaid Attorneys. Note: Attorneys should keep records of their actions. What are co-owned assets? If your Attorney is a family member, you may be joint owners of property. It is important to state this in your document, so that third parties dealing with your Attorney understand that the Attorney is entitled to co-own assets with you. Otherwise, the co-owning of assets could give the impression of impropriety. Do I have to record or register my Power of Attorney with the Land Titles Office?Generally speaking, a Power of Attorney has to be registered with a land titles office/department if it could affect real property (land or other real estate). For example, if the Attorney is authorised to mortgage or sell the Donor's real estate, or to purchase real estate on behalf of the Donor, the Power of Attorney will probably have to be registered at the appropriate office. Usually there is a fee for registration of the document. Additionally some jurisdictions provide stricter registration requirements. In Tasmania, all Powers of Attorney (whether general or enduring) must be registered with the Recorder of Titles. In Northern Territory, all Enduring Powers of Attorney must be lodged at he Registrar-Generals Office. Is any stamp duty payable on my Power of Attorney? No stamp duty is payable on a Power of Attorney in Victoria.

7 Bad Signs You May Be Accidentally Sending at Work
7 Bad Signs You May Be Accidentally Sending at Work 7 Bad Signs You May Be Accidentally Sending at Work When it comes to how youâre perceived at work, it might be tempting to think that the quality of your work is all that matters. But the reality is that your colleaguesâ perceptions of you depend on much more than just the work you produce. Consciously or unconsciously, most people in a workplace pay attention to everything from who you hang out with to how youâve decorated your office. And while that might sound superficial, itâs human nature to make assumptions from all the data you give people. Wondering what signals you might be sending without even realizing it? Here are some of the most common. 1. What Time Do You Arrive and Leave Each Day? In most workplaces, the number of hours you spend in the office still matters. If youâre out the door as soon as the clock strikes 5 PM every day or if you regularly show up after 10 AM, you risk being seen as someone whoâs putting in the bare minimum, not fully committed to work, or even âgetting away with something.â In fact, research shows that even if you have your bossâs explicit permission to work a flexible schedule, managers often assume that employees who show up at work later in the day are less conscientious and less effective at their jobs. (The good news? You might be in luck if your manager is a night owl. Researchers also found that night owls are less likely to judge people by what hours they choose to work.) More From DailyWorth Want to Make the Right Impression? Pick the Right Props Are You Inadvertently Sabotaging Your Success? The 7 Biggest Mistakes Managers Make 2. Who Do You Hang Around With at Work? No matter how good your work is, if your closest work relationships are with co-workers who slack off, chronically complain, or have strained relationships with your organizationâs management, youâre at risk of being seen the same way. Colleagues will assume that you wouldnât be spending so much time with these particular work mates if you didnât share a similar orientation to work or at least sympathize with their viewpoints. Whether or not thatâs reasonable is up for debate, but itâs a common perception. Of course, the opposite of this is also true: If you mainly hang out with your companyâs high achievers, youâre more likely to be seen as possessing a similar work ethic and approach to office life. (And it might even rub off for real- group norms about work ethic are often contagious!) 3. How Do You Behave in Meetings? Yes, if youâre like most people, you attend too many meetings and struggle to stay awake at times. But if you regularly remain silent in meetings and donât participate, your colleagues are likely to think that you either donât have much to contribute or that youâre disengaged. The latter is especially true if youâre obviously checking your phone, responding to emails, or otherwise preoccupied with your laptop screen. Other meeting behaviors might be sending off signals you donât intend as well. Spending the meeting slouched down into your chair can make you come across as uninterested or lacking confidence. Looking impatient to get your turn while others are speaking can make you seems overly aggressive or simply rude. And of course, donât forget to think about your facial expression: If youâre rolling your eyes or looking angry in a meeting, people are likely to notice it and think it anything from unprofessional to signs of a serious attitude problem. 4. How Do You Decorate Your Office? Just like you might expect people to draw conclusions from how you dress and groom yourself, theyâll also draw conclusions from the way you decorate your office. If your workspace is completely bare of any personalization- no photographs, no personal trinkets, nothing on the walls- you might be giving the impression that youâre just passing through. Rightly or wrongly, adding an art print and a few photos or knick knacks can show the space is inhabited and help change how people see you. Of course, the opposite end of the spectrum comes with problems too. If your desk and shelves are spilling over with personal photos and figurines and visitors have nowhere to sit because your collection of clay rabbit figurines is taking up every spare surface, you risk looking like your focus is on something other than work. If youâd need to rent a small van to carry all your personal belongings home, it might be time to pare things down. 5. How Do You Interact With Higher-Ups? How you interact with senior leaders will often shape how people view your readiness for more senior roles- and if youâve ever seen anyone do it wrong, you know how much it matters to get it right. Some people are overly stiff and formal when talking with their companyâs leaders, which in most modern workplaces will come across as tone-deaf. Nor do you want to appear intimidated, obsequious, or overly concerned with being deferential. Of course, on the other extreme, you also donât want to bulldoze over higher-ups (or anyone!) in conversation or be overly adversarial. Itâs fine to express dissent- and savvy leaders donât want yes-men (or yes-women)- but if you cross over into pushy, youâll come across as inappropriately aggressive. 6. How Do You Treat the Janitor? Youâre probably at least reasonably warm and polite to your boss; after all, your paycheck is riding on it. But how do you treat the office janitor, the temps in the mailroom, or the guy who sells pretzels in the lobby? The old saying about judging a date by how he treats the wait staff applies at work too. If you snap at people or donât acknowledge their presence- regardless of their role- youâll come across as a jerk. But if you treat everyone with respect and warmth, youâll usually earn respect at all levels. 7. How Do You Deal With Mistakes? I used to tell my staff that in nearly every case, the way they handled a mistake mattered far more to me than the mistake itself. Downplaying a mistake is one of the worst things you can do on the job. If your boss isnât confident that youâll give her bad news directly or be forthright about a problem, youâll destroy her trust in you. If you donât proactively own up to and take responsibility for mistakes, youâre signaling that she canât count on you to keep her informed when it counts. A smart manager will respond to that by giving you less autonomy and high-profile, important work. The best thing you can do when you make a mistake it to come clean. Explain what you did, why you were wrong, and what you propose doing about it now. This also works in retrospect. For instance: âDo you remember how last month I argued for moving forward with that project when Jane insisted it was a bad idea? I was wrong. Hereâs what I've realized since then.â This type of candor and responsibility-taking is powerful because it instills in your boss the confidence that you will give her bad news directly, and she wonât need to worry that sheâll only get negative information if she digs for it. Defeating the #8220;MBA Bully#8221; to Gain a Successful Career
Defeating the #8220;MBA Bully#8221; to Gain a Successful Career Defeating the #8220;MBA Bully#8221; to Gain a Successful Career Even though it may feel like bullying, MBAs are designed to âpush you aroundâ in the right way to further your learning to a successful career. If a student wants to take an MBA course, he or she is mentally challenged at stage one: doing well on the GMAT (Graduate Management Admission Test). This is a priority as the higher the GMAT score, the better your chances of getting accepted in to a prestigious business school. Once youâre accepted, you will be pushed at every other level with an MBA, using technical skills for finance and accounting, analytical skills for corporate strategy and strategic planning, and interpersonal skills to motivate marketing, operations and sales. All these levels will then push you on to gaining a job as a graduate once qualified. And, with a high GMAT score, who would not want to employ you and give you a career. Most of us have a strive to do better and reach any potential goal that is put in front of us, but sometimes the fence we have to climb can challenge even the brightest individual. An MBA course, in many ways, can be a metaphorical bully. Dealing with the MBA Bully Student life is tough enough as it is, but when a student opts for an MBA, thatâs when itâs really time to knuckle down. Despite some peopleâs viewpoint on students- that they are lazy binge drinkers- there is a lot of work for students to complete and a lot of deadlines theyâre required to meet. The HealthyFit group at the University of Vigo in Spain recently conducted research that showed that 51 percent of females were binge drinkers and 41.3 percent of males were binge drinkers; yet, both groups were still actively finishing their courses at the university. Student binge drinking is frowned upon and it is a stressful situation to be in, but why do students resort to this activity in the first place? Could it be due to the pressure of courses like those taken for an MBA, course that have far too much work to handle? Or is it just a student looking for social acceptance? This is why it can look like a student is being bullied, but drinking is never the answer. Thankfully, the students of today have a large amount of resources- Internet, libraries and the most popular mobile phone apps- to utilize and defeat the bully and not turn to drinking. Some may even say they have everything at their fingertips, but is beating a bully that simple? It is indeed; accessible information and research exist and can be used as self-defense weapons. Students will spend more time addicted to their technology to learn more, which can fight away any temptation to drink and instead they learn more on the go. For those considering an MBA as a course choice, it may feel like a mental bully of decisions, but resources are available to help MBA students find out more about their end career goals and what MBA is best suited for them. Interactive tools, such as the QS Scorecard, allow students to create personalized MBA rankings gathered from data of hundreds of business schools. Students can rank MBA programs based on what criteria is most important to them, takin g into consideration entry level requirements, return on investment, scholarships, locations, duration and costs. An MBA can be hard work, as the MBA can be seen as pushing the student around by constantly forcing him/her to hit deadlines and produce work of the highest order. It could be judged as picking on students by continually testing them to their limits, almost until they crack. An MBA is tough and not meant to be easy. It is a masterâs degree that requires serious dedication and hard work. The brain will be overloaded with fear, similar to how a bully makes a person feel. However, bullies can be stopped in their tracks! It is how a student approaches his/her course with disciplines that stops a bully in their tracks. The core success of passing an MBA course lies with studying areas of business related to accounting, finance, operations management and marketing. Students these days do receive a lot of negativity, being branded as ââtax-dodgersââ and âlazy kids,â but, as you can see, they do have other worries too. It is a pressure cooker of emotion, pain, mental strength, intelligence and deadlines that all combine to create a unique situation for any young adult. It is how that individual deals with the pressures and expectations that will help shape their future careers. MBAâs have the potential to produce successful careers. Ever heard of Shaquille ONeal? He is a retired professional basketball player who is a four-time NBA champion and has an MBA from the University of Phoenix. How about George W. Bush, you all must know this former president? Well, he too has an MBA from the Harvard Business School. Whether it is sports or politics you end up in, as you can see, this degree can lead to a successful future.
